Employer Agent

The key role of the Employer's agent is to act on behalf of the Employer to manage a project through to completion. It is role often undertaken by a Commercial Building Surveyor such as Richard. It can be combined with other roles, such as the project manager.

 

An Employer’s Agent role is instrumental in ensuring that works are undertaken to a high standard and in accordance with the employer's requirements and current building standards, ensuring the work is completed on time, safety procedures are followed, and budgets are met.

It is necessary to engage an Employer's Agent when works are procured under a Design and Build Contract such as the JCT Design and Build Contract 2016. Equallly it is advisable and potentially more important to engage an Employer's Agent when the work is more adhoc.   They are typically engaged at the outset of a project to assist with the delivery of the feasibility and concept design stage.

Their duties include:

  • Coordinating the design team and pulling together the tender pack. 

  • Identify the contractors to tender to.

  • Reviewing and analysing the tender submissions, meeting with contractors and providing recommendations for the preferred contractor.

  • Assisting with drafting consultants' appointments, innovation agreements and warranties.

  • Reviewing and considering design items submitted by the contractors throughout the works.

  • Reviewing and issuing instructions.

  • Tracking and monitoring the progress of the construction works and issuing the client with regular update/progress reports.

  • Averting potential disputes and assisting with settling disputes if they arise.

  • Receiving and reviewing the proposed final account and agreeing and certifying.

  • Implementing the requirement for snagging during the rectification period.
